A “Hail Mary” of sorts for The Boston Bomber

The Wall Street Journal has reported that the lawyers for Dzhokhar Tsarnaev, the surviving Boston Marathon Bomber from 2013, are requesting a new trial. Two of their arguments seem obvious – that the general feeling around Boston prejudiced Tsarnaev and that jurors’ social media feeds biased their verdict – but they have also raised the nonobvious claim that the attack was not a “crime of violence” and consequently the penalty phase needs to be reassessed.
